We restrict access to information about you to those workers who need to know the information to respond to your inquiry or request. Workers who misuse personal information are subject to disciplinary action.

Abuse Of Services Offered / Right To Refuse Service

You may not use the services of Avento to post, publish or transmit any unlawful or objectionable information of any kind, including threats, obscenity or pornography, profanity, or, including without limitation, any activity that would constitute or encourage any criminal offense, civil liability, or violate any local, state, national or international law. You may not post or transmit viruses or any other harmful components or inhibit or restrict anyone else from using the Internet.

You may not transmit, reproduce, or in any way exploit any information, software, or other material obtained through Avento for commercial purposes (other than as expressly permitted by the provider of such information, software or other material). Avento assumes no obligation to monitor the service. However, you agree that Avento has the right to monitor the service and disclose any information necessary to satisfy any law, or legal government request, and to operate properly, or to protect itself or its users. Avento reserves the right to refuse service without notice or to remove any information at its sole discretion.

Avento will not tolerate abusive customers and expects all customers to respect the Terms and Conditions as set forth on the Avento website and the client’s contract. Customers who verbally abuse employees of Avento or do not follow our guidelines set forth for completing projects and or communicating support requests will have services terminated immediately and without refund. Avento does not tolerate abusive, offensive, dangerous, language or behavior. Abusive communications in any form (email, phone, in person, etc.) are not tolerated.

Legal Matters

If at any time a client or Avento feels necessary to take matters or disputes to the legal system, Avento will immediately freeze all services, communications, and transactions with the client until the case has been decided. Avento is not responsible for any presumed lost profits, work stoppages, or email communications during this time. This also applies if a client threatens or implies that they will take matters or disputes to the legal system. Avento will not work for a client under threat of a lawsuit or other legal action.

Payment, Fees, & Refunds Policy

Full payment is required before any service is rendered, which includes renewals. For monthly accounts, prepayment is due each 30 days following the date the account was established. Billing will continue until you cancel your hosting account. You may cancel at anytime. Invoices are usually sent by e-mail automatically by our online billing system, unless another billing method is requested by you and agreed upon by both parties.

If payment is more than 15 days past due, a Rs.1500/- late charge will apply. Avento reserves the right to remove any web services from viewing on the Internet, to include email access, if payments are not made. If web services are suspended, a Rs.5000/- re-activation fee will be applied to any outstanding balance before services are restored. In case collection proves necessary, the Client agrees to pay all fees (including all attorney’s fees and court costs) incurred by that process.

As a policy, we do not offer credits or refunds for web development/hosting time already expended.

This only applies to cancellation by the client. If cancellation is done by Avento due to restrictions violation, there will be no refund. Avento will only allow for the discount if cancellation is not the fault of the client, as determined by Avento. All monetary transactions are in Indian Rupees. Additional features can be added at any time. Monthly feature prices are not prorated. Avento reserves the right to change prices at any time.

You may cancel at anytime. To cancel your account, please submit a request to us using our “Contact Us” form or call us at (0413) 2246700. We may send you an email to confirm that you wish to cancel.

Project Timelines

Projects can be hindered if the client does not provide feedback or required elements in a timely manner, such as feedback on a design mockup, requested sitemaps, text to be used as content on the web pages, photos for either the design or for the content, the client’s logo, appropriate account login information, etc. For that reason, if Avento is waiting for content or other piece of information, the client will be notified. If the client fails to handle the requests within ten business days, then Avento will take any or all of the following steps to keep the project moving forward in a timely manner:

MOCKUP FEEDBACK – If the client fails to give feedback on the design mockup within ten business days, by default, the mockup is approved. If the client later wishes to change the design, additional charges may apply.

SITEMAPS OR PAGE NAMES – If the client fails to provide the requested list of web pages within ten business days, by default, Avento will assign page names. If the client later wishes to change these page names, additional charges may apply.

CLIENT LOGO – If the client fails to provide a copy of an existing logo within ten business days, a substitute logo or company name graphic may be used. If the client later wishes to change the substitute logo or company name graphic, additional charges may apply.

PHOTO TO USE IN DESIGN – If the client has requested the design include a particular photo, and the client fails to provide the required photo within ten business days, a substitute photo may be used. If the client later wishes to change the substitute photo, additional charges may apply.

HOME PAGE TEXT – Avento will provide a content writer for home page text. If, for a period of ten business days, the client fails to be available for a telephone interview with the writer, then the writer will compose the initial text without having interviewed the client, that text will be automatically used, and the client may change it later himself using the content management system (CMS). If the client is available for an initial interview in a timely manner, then the writer will also provide one round of revisions after the initial text has been written. If, for a period of ten business days, the client fails to offer any feedback on the home page text provided, then by default, that text is approved, and the client may change it later himself using the content management system (CMS).

TEXT AND OPTIONAL PHOTOS FOR ALL OTHER WEB PAGES – Unless the writer has been hired for additional pages, it is the client’s responsibility to provide content for all other pages in the website. If the client provides all text (and optional photos) within ten business days, then Avento will add that content to the website. If the client fails to provide content for those pages within ten business days, then Avento will complete those pages with simple placeholder text such as, “ABC Client offers many XYZ Services. For more information, please contact ABC Client.” The client will have the ability to add more complete content later using the content management system (CMS).

OTHER ELEMENTS OR ADMINISTRATIVE DUTIES – There may be other elements required such as passwords for existing domain names, etc. Regardless of what element may be required, if the client cannot or will not provide the required element or information within ten business days, Avento reserves the right to make substitutions, leave elements out, or take other actions in order to complete the project.

Indemnification Policy

You agree to use all Avento services and facilities at your own risk. Avento specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Avento be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.

Customer agrees that it shall defend, indemnify, save and hold Avento harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Avento, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.

Customer agrees to defend, indemnify and hold harmless Avento against liabilities arising out of:

  • Any injury to person or property caused by any products sold or otherwise distributed in connection with Avento’s server;
  • Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party
Spam Policy

Avento takes a no tolerance approach when dealing with spam and other types of UCE (unsolicited commercial e-mail).

Avento defines spam as any type of unsolicited email used for any purpose. This includes, but is not limited to:

  • Using a non-existent return email address when sending commercial solicitations.
  • Mail-bombing (sending numerous messages to the same user).
  • Subscribing someone else to a mailing list without that person’s permission.
  • Posting the same article to multiple newsgroups.
  • Using another network to send spam that relates in any way to Avento or any site hosted by Avento (including your site).
  • Sending bulk e-mail without providing a way for the receiver to unsubscribe
Traffic (Bandwidth) Use Policy

Avento allows for very generous traffic, and most sites never exceed 500MB per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. Avento customers are discouraged from storing any files that cause excessive traffic on Avento servers. Please contact Avento Technical Support team for more information. Again, 99% of the sites do not fall into this category and never reach our traffic limits.

We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law.

Any deliberate attempt to cause damage to Avento or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

Account Access

Servers owned by Avento are under restricted access. We maintain strict physical, electronic, and administrative safeguards to protect your personal information from unauthorized or inappropriate access. Third Party entities or persons are not allowed to access our servers without express written permission from Avento Designs. If a client gives access to a third party entity or person to their account without this authorization, the services for that client will be terminated immediately and without refund.

There may also be a fee (payable in Indian Rupees) charged to the client for damages to files, programs, or other server functions. In addition, attempts to circumvent security, reverse engineer our programs, or access areas of the server that you have not been authorized to with written permission from Avento will result in immediate termination without refund.

Ownership and Copyright

All text and photos used as content in a commissioned website must be provided by the client (unless the client has hired Avento for content development). The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her design and/or content does not infringe on any trademark, service mark, or copyright. Avento cannot be responsible for intellectual property infringements on behalf of clients. Also, Avento cannot be responsible for submitted content. Clients should not mail irreplaceable photos or documents or send content that must be returned.

SEO General Terms

Please read the following information before engaging Avento. Hopefully this makes it clear for you but if unsure, please ask. .

When you enter into a contract with Avento, you agree to be bound by and consent to these terms and conditions. If there are problems with our service that arise, please contact us immediately in writing, include all relevant information and explain the issue. We’ll try to settle your complaint in a satisfactory manner.

Marketing Policy

Although we won’t divulge details about clients to other clients, potential or existing, we ask that you allow us to mention you in our Cases webpage. This will include a link to your page that we got onto Google’s first page and the phrase that it’s found with.

Important Definitions

  • The Client: You, the individual, organization or business that is contracting with Budget SEO
  • Budget SEO: Us, the collective employees, affiliates, or other agents of Budget SEO.
  • Your Site: The website whose page(s) you wish Avento to perform SEO on.
  • Page One: The intended search result for a page of Your Site for an Agreed Phrase.
  • Agreed Phrase: This is the phrase agreed by The Client and Avento that a specified webpage shall be optimized for.
  • Engagement Fee: A non-refundable payment of Rs.6000/- (or equivalent in other currencies).
  • SEO Fee: A payment of Rs.6000/- (or equivalent in other currencies) per month for six months. Halved for additional pages after the first.
  • Maintenance & Monitoring Fee: A payment of Rs.2500/- (or equivalent in other currencies) per month after the initial six months. This is halved for additional pages after the first.

Things We Require from You During the Service Period
Avento requires that while we are engaged by you that:

  • No other SEO company is working on Your Site while we are.
  • You or anyone else won’t use any “black hat” techniques, including but not limited to exchanging links with link farms, use spamming or SEO techniques, or otherwise do any online activities that may cause Your Site’s Google search engine ranking to drop.
  • Your Site is not hosted with a free hosting service but on paid hosting such as for instance a shared server, VPS or dedicated server.
  • You allow Avento the necessary access to edit web pages of Your Site as we require.
  • You give Avento the authority to submit Your Site webpages to whereever we feel necessary.

Contract: Overview

Avento requires that an order be placed for our services via email and we’ll confirm receipt of the order by email, then send an invoice for the Engagement Fee. .

This order is considered to be a contract between the client and Avento. The terms and conditions set forth below are considered binding, and may not be altered in any way by employees or agents of Avento.

The contract is considered to be in force for a period of six(6) months, and after which time the client may switching to a Maintenance Contract by notifying Avento of their wish to do so.

If Avento having started the contract determines that it will no longer be able to place one or more of The Client’s specified Web Page on Page One results then all previously paid SEO Fees for that page(s) shall be refunded to the Client.

Failure to pay a SEO Fee. Unless Avento has agreed to terminate the Contract. The Client is liable for the SEO Fee for every page contracted and Avento will require unpaid fees up to the current date. The contract will then terminate.

Contract: Financial Obligation

Avento shall produce a monthly report and email The Client with that report and Invoice for Rs.5000/-, every month for six months and at the Client’s option a Maintenance Contract to continue afterwards.

Avento SEO Services

The initial contact of the Client via the Avento contact form should specify the domain, web page and desired search phrase. Avento will then investigate whether it can promote the specified page to Page One on Google.com or Google.co.uk or some other regional Google site as specified by The Client. Avento may suggest alternative phrases that it believes will lead to higher traffic when the web page is on Page One of Google’s results.

Search Engine Optimisation: Explanation of Services

By entering into a contract with Avento, the client asserts that they have read and are aware of the following statement:

Search Engines, particular Google have proprietary algorithms, techniques and software that affect how search results are ordered for a given search. These algorithms etc change periodically with a consequent change in ordering. Avento tracks these changes in order to minimize down time when Your Site drops out of Page One’s results. It also means that while we may be abe to guarantee that your site will eventually be located on Page One, we cannot say exactly what ranking Your Site will have on Page One or how much traffic this will bring.

While a top ten ranking assignment means that the customer’s page will be placed in the top ten in a search result, this can take up to 20 weeks to occur as we upload optimization to the customer’s website. While Google results are often displayed on other search engine sites, Avento is solely focused on producing optimised results for the Google search engine only. It is our primary goal to increase visibility and to gain a higher search engine rank for our clients. This again, applies only to Google.

Avento must thoroughly stress that there is no guarantee to our services. We do not have the ability to offer an ironclad guarantee on the rank that our customers will receive. We also cannot calculate or even estimate the amount of increased traffic that will occur as a result of our optimisation services. Marketing online is unpredictable and Avento cannot in any way guarantee the position that a site will earn except that it will be on the first page.

Avento must be granted the right to optimise our customer’s website. This can sometimes cause a slight visual impact, but is normally not noticeable. We will work with our customers to ensure that the page is left intact and that only the most minimal of changes takes place.

Our customers must supply Avento with their logins and passwords for FTP purposes to allow us full access to the website. Avento will fully protect all login and password information, keeping it under the tightest security. It is vital that customers inform their webmaster and any other individuals that work with their website that Avento is optimising the website.

Avento will make the final and complete decision on which search engines they deem most important to work with, however it’s almost always going to be Google.com, .co.in or some other local variant. We will base our decision solely on these factors: content, location, language, popularity or any other attribute that we feel is important to consider.

Avento will suggest phrases that search engine users will search for at their discretion. The positioning of these words will be used in the optimisation process. A listing is the search result page of a word or phrase that Avento has typed into a search engine. This will provide the positioning of the customer’s website in the search engine listing. The customer’s website name and possibly links to the customer’s website will be included in the listing. The words that Avento chooses will be for test purposes and will be considered a test phrase. Although these websites and links will be listed with other testing phrases, there will be only one single test phrase in the report that we prepare.

All notices must be in writing. All notices and communication to Avento must be addressed correctly to Avento (76, First Floor, Sithankudi Main Road, Pondicherry -13, India) or other such addresses as supplied directly from Avento. Notices that are sent from Avento to our clients will be considered valid if they are sent to the mailing address as it appears in our terms of service agreement or such address as was supplied by our customer in writing.

In case of any invalidity or un-enforceability of any portion of this agreement shall in no way affect, impair, or nullify any other portion of this provision. No waiver of the due rights that Avento has under the protection of this agreement shall occur due to any failure of Avento to successfully enforce any portion of this agreement.

Agreement Disclaimer:

The signing of this agreement on behalf of the customer warrants that the signee has the authority to commit the client to the entire agreement and also confirms that this agreement is a binding agreement between two businesses. If any payments for the customer are made through a credit card, debit card, bank transfer, or demand draft that is not in the customer’s name or the customer’s business name, then it is the sole responsibility of the customer to reimburse any and all payments to the card or bank account holder from which the payment was made on behalf of the customer.

Our Payment Terms and Conditions:

We will accept online money transfer, cash and cheque.

Please note that if paying by cheque, we will not commence on any work until the standard 5 working days have passed since we received the cheque. This allows for time for the cheque to clear our bank.

In the case of a customer’s monthly payment plan for our search engine optimisation services, all payments must be made on the first day of the month or at least on the first business day of the month. We will charge a 5% interest charge against the outstanding balance for every month that the customer’s payment is delayed.

Loss of Service:

Avento accepts no liability in the case of a loss of service, files being unavailable or inaccessible, damage of data, misuse of equipment by other clients, failure or breakdown of externally managed equipment, or any communication devices /or services that are beyond the control of Avento.

Security:

We do not in any way have or offer any affiliate/reseller type of program. We do not have resellers or affiliates. We only accept outsourced project requests if there is a true benefit to the customer and there is a written agreement. It is important to note that Avento will hold no responsibility for a third party outsourced business.

We will never ask for any of your financial information.

You should only share your personal usernames and passwords once you have signed your agreement.

If Avento must create any accounts for the work carried out, then we will make every effort to make the email address and password the customer’s own email address and password so that the customer has complete control over the account. All accounts that are created will be fully documented and sent to the customer via email.

We will never have a third party contact you by email or by phone unless this is a part of the original written agreement or has been agreed upon through email beforehand.

Search Engine Guarantee

Most every client would like his/her website to rank high in search engine results for selected keywords, yet search engine results are determined by a multitude of constantly changing factors, third party search engines, and the amount and quality of competition on the world wide web. Avento guarantees certain search engine-friendly techniques will be used in the creating of each custom website, such as keywords in the title bar, the meta tags in the hidden coding behind the scenes, and alternate text behind some images. If the keyword placement in these three areas is not to the client’s liking, Avento will change these three items to the client’s choices one time for free. Subsequent or additional changes will be billed at the standard hourly rate. Additional search engine optimization (SEO) services are available for additional fees. Avento cannot be held responsible for search engine results.
